Terms of Service

Plain terms for a tool that mostly runs on your own device, with your own content.

These Terms of Service ("Terms") govern your installation and use of the HushBook mobile application ("HushBook", the "App"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The service

HushBook is an audiobook player that can (a) play audio, (b) generate on-device, word-level transcripts and synced read-along text, and (c) offer features such as a public-domain catalogue, reading/listening analytics, and accessibility features.

On-device by default. The App is designed to run locally on your device. HushBook does not store your imported audio files, transcripts, saved quotes, or listening progress on a HushBook server. There are no user accounts and no sign-in; because there is no account, there is nothing to delete on our side — removing the App deletes the data stored on your device.

Diagnostics. The App sends limited crash and performance diagnostics to help us fix bugs and improve reliability. See the Privacy Policy for exactly what that involves.

2. Who can use the App

The App is intended for general audiences and may be used by anyone. If you are under 18 years of age (a "child" under India's Digital Personal Data Protection Act, 2023), you may use the App only with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the App.

By using the App, you represent and warrant that:

3. Licence to use the App

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download and use the App on a device you control, solely for lawful purposes and in accordance with these Terms and the applicable app-store rules.

All rights not expressly granted to you are reserved by HushBook and its licensors.

4. Your content & imports

4.1 Your content. The App allows you to import and play audio files that you provide ("User Content"). You represent and warrant that:

You retain all rights in your User Content. We do not claim ownership of it.

4.2 On-device processing. Imported files and transcripts generated from them are stored on your device. You are responsible for maintaining backups and protecting your device. Uninstalling the App may delete locally stored data.

4.3 No piracy / misuse. HushBook is a personal tool for content you are entitled to use. You must not use the App to obtain, copy, process, share, distribute, or enable access to copyrighted works where you do not have the necessary rights.

Important: HushBook is a personal tool for content you are entitled to use — not a way to obtain, share, or distribute copyrighted audiobooks. Using it to copy or process works you don't have rights to is a breach of these Terms and may break the law.

6. Public-domain catalogue and third-party services

The App may surface and/or fetch public-domain titles and related metadata from third-party sources (for example, LibriVox and the Internet Archive) and may download speech-recognition models from third-party hosts.

7. Purchases and refunds

HushBook offers free features (including a read-along player and free public-domain content) and optional paid in-app purchases. Paid purchases are made through, and billed by, the app store from which you downloaded the App (Apple App Store or Google Play), under that platform's terms.

Refunds for eligible paid in-app purchases are handled in accordance with our Refund Policy and the refund rules of the relevant platform. Please see the Refund Policy for how to request a refund.

7.1 Subscriptions and auto-renewal. Where HushBook offers an auto-renewing subscription, the subscription title, price, billing period, and what it includes are shown on the in-app purchase screen before you buy. Unless you cancel, the subscription automatically renews at the end of each billing period and your store account is charged the then-current price for that period. An annual plan is billed once per year at the annual price.

7.2 Free trials and introductory offers. If a free trial or introductory offer is provided, its length and the price and billing period that apply when it ends are shown before you start. Unless you cancel before the trial ends, it automatically converts to a paid, auto-renewing subscription.

7.3 Managing and cancelling. You manage or cancel a subscription in your store account settings: on iOS, Settings > your Apple Account > Subscriptions; on Android, Play Store > Payments & subscriptions > Subscriptions. Cancellation takes effect at the end of the current billing period; cancel at least 24 hours before a renewal to avoid being charged for the next period. Cancellation is handled entirely through the store.

7.4 Price changes. Subscription prices may change. Where required, Apple or Google will notify you in advance and, where their rules require, seek your consent before a changed price takes effect; the notice and consent mechanics are handled by the store.

7.5 Statutory withdrawal rights (EEA/UK). If you are a consumer in the EEA or UK, you may have a statutory right to withdraw from a purchase within 14 days. Because subscriptions and digital content are supplied immediately on purchase, this right may be lost once supply begins with your consent. Where these rights apply, they are exercised through the store, which acts as merchant of record and captures the relevant consent at checkout; nothing here limits any mandatory consumer rights.

8. Updates and changes to the App

We may modify, update, or discontinue the App (or any feature) at any time, including for security, compliance, or operational reasons. Some updates may be required for continued use.

9. Termination

These Terms are effective until terminated. We may suspend or terminate your licence to use the App if you materially breach these Terms. Upon termination, you must stop using the App and delete it from your devices.

Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.

10. Disclaimers

The App is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law:

Consumer rights. Nothing in these Terms excludes or limits any rights you may have under applicable law that cannot be excluded or limited.

11. Limitation of liability

To the maximum extent permitted by applicable law, HushBook and its developers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, revenue, or goodwill, arising out of or related to your use of (or inability to use) the App.

To the maximum extent permitted by applicable law, our total aggregate liability for all claims relating to the App will not exceed the amount you paid for the App feature giving rise to the claim in the 3 months before the event, or INR 100, whichever is higher.

12. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, courts at Bengaluru, Karnataka, India will have exclusive jurisdiction over disputes arising from these Terms.

13. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date will reflect the latest version. If you continue using the App after updated Terms are posted, you agree to the revised Terms.
